A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Cet article propose une lecture critique du Despotisme de la Chine, un texte riche mais peu commenté, où Quesnay expose explicitement le contenu de sa pensée politique. Par l’analyse de Despotisme de la Chine nous voudrions défendre trois idées qui font sens autour de la représentation de la Chine qui est faite par Quesnay. La première est naturellement de montrer en quoi ce texte est représentatif de la pensée de Quesnay (et, plus largement, de l’école des physiocrates). La deuxième est (...) de souligner que le cas de la Chine, tel qu’il est vu par Quesnay, permet de penser l’économie en tant qu’activité, discipline, ou même science qui se situe au cœur du fondement de la philosophie politique qu’il avance. La troisième est d’indiquer comment la compréhension des logiques économiques d’après Quesnay relève finalement d’une observation intelligente du réel, de lier la loi positive (le politique fondé par l’économique, pour ce qui est alors connu de la Chine) et la loi naturelle (en somme : ce qui est et ce qui doit être). Au cœur de ces trois vues se trouve une réflexion sur ce pays lointain et nul autre (sinon la France). Loin d’être un simple prétexte pour avancer ses arguments, la Chine est surtout une façon de voir, de révéler, de saisir la nature d’une pensée (la physiocratie), d’une discipline (l’économie), et de sa portée (la science et le politique). Kierkegaard e Freud pensam que o sujeito moderno é incapaz de compreender corretamente a si mesmo. O homem é uma auto-relação e esta está rompida. O psicólogo kierkegaardiano e o psicólogo freudiano tentam recompor esta auto-relação.

Parental burnout is a unique and context-specific syndrome resulting from a chronic imbalance of risks over resources in the parenting domain. The current research aims to evaluate the psychometric properties of the Spanish version of the Parental Burnout Assessment across Spanish-speaking countries with two consecutive studies. In Study 1, we analyzed the data through a bifactor model within an Exploratory Structural Equation Modeling on the pooled sample of participants obtaining good fit indices. We then attained measurement invariance across both gender (...) and countries in a set of nested models with gradually increasing parameter constraints. Latent means comparisons across countries showed that among the participants’ countries, Chile had the highest parental burnout score, likewise, comparisons across gender evidenced that mothers displayed higher scores than fathers, as shown in previous studies. Reliability coefficients were high. In Study 2, we tested the relations between parental burnout and three specific consequences, i.e., escape and suicidal ideations, parental neglect, and parental violence toward one’s children. The medium to large associations found provided support for the PBA’s predictive validity. Overall, we concluded that the Spanish version of the PBA has good psychometric properties. The results support its relevance for the assessment of parental burnout among Spanish-speaking parents, offering new opportunities for cross-cultural research in the parenting domain. (shrink)

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. The Association of Philosophy and History of Science in the South Cone is a non-profit academic association, founded on May 5th, 2000, in Quilmes, Argentina, at the closing ceremony of the 2nd Meeting of Philosophy and History of Science in the South Cone. The creation of this Association was the result of the interest to deepen and strengthen the exchange between the researchers in Philosophy and History of Science from the countries of the South Cone, from the two first meetings (...) that took place in Porto Alegre and Quilmes onwards. Since then, there have been biennial meetings organized as its responsibility. The main aim of AFHIC is to contribute to a better understanding of science from a philosophical as well as a historical point of view in the Spanish and Portuguese-speaking countries, especially in those which belong to the American South Cone, promoting a space for reflection, exchange, discussion, communication, and dissemination of such an understanding. This volume is - with minor changes - the English version of Fisica: Estudos Filosofi cos e Historicos. It is composed of refereed and, in some cases, opportunely modifi ed contributions made by members of the Association of Philosophy and History of Science in the South Cone, some of them who are unfortunately no longer among us. En este trabajo ofrezco un análisis de algunas de las ideas más importantes sostenidas por Ricardo Caracciolo en su ensayo sobre hechos y justifi cación de las decisiones judiciales. Estas tesis son: a) tesis de la aplicación posible. Las normas generales sólo se pueden aplicar a los casos que ellas regulan; b) tesis de la aplicación efectiva. Una norma general es aplicada a un hecho sólo si la premisa que describe ese hecho es verdadera. Este artículo muestra que hay buenas (...) razones para revisar ambas tesis ya que ellas pasan por alto una distinción relevante entre distintos sentidos de ‘casos individual’: casos individuales de un universo del discurso y casos individuales de un caso genérico. Como consecuencia de ello, se señala que es necesario modelar un concepto de justifi cación jurídica que no presuponga a esas mencionadas tesis. (shrink)

Este trabajo es una crítica a la distinción entre lagunas de conocimiento y reconocimiento. En Normative Systems, Alchourrón y Bulygin sostienen que estas indeterminaciones en la aplicación del derecho son problemas diferentes. Según AB, las lagunas de conocimiento surgen por nuestro deficiente conocimiento de las circunstancias del caso, pero las lagunas de reconocimiento se producen por la vaguedad del lenguaje. Para resolver las lagunas de conocimiento, los juristas usan presunciones y para resolver las lagunas de reconocimiento es preciso redefinir los (...) conceptos. Sin embargo, AB no ofrecen una reconstrucción específica de la vaguedad y ello afecta al análisis de esos tipos de lagunas. En particular, AB creen que la vaguedad es un problema epistémico y, por ello, un sistema completo puede ofrecer una respuesta correcta para cada caso individual aun cuando no podamos conocer esa solución. Pero, cuando se asume que la vaguedad es un problema epistémico, entonces no existen mayores razones para distinguir entre lagunas de conocimiento y lagunas de reconocimiento. This paper analyzes the distinction between gaps of knowledge and gaps of recognition. In Normative Systems, Alchourrón and Bulygin claim that both indeterminacies are different problems that arise in the application of general norms to individual cases. Where through ignorance of certain properties of the facts, we cannot determine whether an individual case belongs to a generic case, we speak of gap of knowledge. On the contrary, gaps of recognitions are caused by the semantic indeterminacy of the concepts which define a generic case. In order to solve gaps of knowledge, jurists use legal presumptions, but the solution of a gap of knowledge requires the redefinition of a certain concept. However, AB believe that vagueness is only an epistemic problem. For this reason, they conclude that a complete normative system resolves every possible individual case even though we can still find epistemic indeterminacies. However, this paper shows that if vagueness is characterized as an epistemic problem, there will be no relevant reason for stressing the distinction between gaps of recognition and gaps of knowledge. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la versión (...) fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

In this paper, I consider some problems concerning the structure of legal systems. In order to do this, I basically analyze the promulgation and derogation of legal rules. Frequently, promulgation has been referred to as the introduction of a rule into, and derogation as the removal of a rule from, a normative system. I try to show that there is more to it than that. One of the main ideas of the paper is that the enactment or derogation of a (...) legal rule by an authority na restricts the competence of all lower authorities: Once a rule R has been enacted by an authority na, authorities inferior to na cannot remove R from the normative system; and when R has been derogated by na, lower authorities do not have the competence to introduce R into the system. Further important questions include: What happens with derogated rules? What is the structure of the set of derogated rules? When does a rule belong to a derogated set, and when is it removed from a derogated set? These questions are very important for a theory of legal systems, and I try to give some possible answers. Perhaps the main conclusion of the paper is that promulgation and derogation can be considered very similar processes with respect to legal systems. (shrink)

En 1968 Raquel Carson comenzaba una revolución en el pensamiento, quizá una de las de mayor peso en la actualidad. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican. SummaryIntense, sustained nursing lengthens inter-birth intervals and is causally linked with low natural fertility. However, in traditional settings, the effects of such nursing on fertility are difficult to disentangle from those of nutrition. Results from an prospective, direct observational study of reproductive function in well-nourished Amele women who nurse intensively and persistently but who also have high fertility are here presented. Endocrine measures show that ovarian activity resumes by median 11·0 months postpartum. Median duration of postpartum amenorrhoea is 11·3 months, (...) time to next conception is 19·0 months, and the inter-birth interval is 28·0 months. Average life time fertility is 6·8. High fertility in Amele women is due both to refractoriness of reproductive function to suckling stimuli, and to maintenance of equivalent age-specific fertility rates across the reproductive life span. In his influential paper Legal Reasons, Sources and Gaps' reprinted in The Authority of Law (Oxford: Oxford University Press, 1979), Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the (...) claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principle of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show ‐ with the aid of a sophisticated analytical tool, i.e. von Wright's Truth Logic ‐ that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth‐values. For this reason, Raz's paper can still be regarded as a good starting‐point for analyzing the relationships among norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

Una forma clásica de explicar el significado de una oración es establecer sus condiciones deverdad. Sin embargo, dado que sólo las oraciones declarativas encajan con este tipo de análisis, las oraciones (e.g. imperativas) que carecen de valor de verdad quedan fuera de este análisis. Con el objeto de evitar esta dificultad, algunas veces se ha sugerido que el cumplimiento de un imperativo les el valor semántico de I, y que este valor depende del concepto de verdad. En este artículo, explicamos (...) esta sugerencia mediante un lenguaje artificial: el lenguaje LN. Nuestra propuesta consiste en suministrar una reconstrucción del concepto de eficacia a partir de la relación de cumplimiento, analógamente a la reconstrucción del concepto de verdad a partir de la relación de satisfacción. Nuestras conclusiones principales son las siguientes: 1) el significado de una oración imperativa es establecido por sus condiciones de eficacia y 2) esta teoría del significado de los imperativos suministra una base semántica, adeucada para la lógica deóntica.A classical way of explaining the meaning of certain sentences is to establish their truth-conditions. However, since only declarative sentences fit this kind of analysis, sentences (e.g. imperatives) which lack truth-value remain outside the theory of meaning. In order to avoid this difficulty, it is sometimes suggested both that compliance with an imperative I is the semantic value of I, and that this value is dependent on the concept of truth. In this article, we explain this suggestion with the help of a constructed language: the artificial language NL. Our proposal Is to provide a reconstruction of the concept of effectiveness from the relation of compliance, on the analogy of the reconstruction of the concept of truth from the relation of satisfaction. Our main conclusions are: 1) the meaning of a imperative sentence would be established by its effectiveness-conditions and 2) this theory of meaning of imperatives would provide a semantic basis, suitable to the deontic logic. El objetivo de este trabajo es recoger de forma sistemática las principales reflexiones en torno al tema de Dios y la religión en la obra de Javier Muguerza. Con este esbozo cordial de filosofía de la religión se muestra la evolución en el pensamiento de Muguerza desde una filosofía analítica de la religión —preocupada por esclarecer el análisis lógico del lenguaje religioso y la dimensión racional de la creencia religiosa— a una filosofía práctica de la religión —centrada en las condiciones (...) de posibilidad del diálogo entre creyentes y no creyentes y en la reflexión conjunta sobre valores compartidos como la esperanza—. Por último, se defiende la tesis de que las contribuciones de Muguerza en este campo constituyen un claro ejemplo de filosofía de la religión realizada desde el respeto de la increencia. (shrink)

Este artículo continúa la investigación iniciada en «Los trasmundos del joven Ortega (1902-1914)». En esta ocasión, reconstruiré algunas ideas en torno a la religión y Dios presentes en los años correspondientes a la primera navegación de Ortega. El objetivo es superar las interpretaciones reduccionistas que rápidamente identifican a Ortega como una persona reacia a la religión. En primer lugar, recuperaré una categoría clave de la primera navegación, “la altura de los tiempos”, para mostrar cómo Ortega sitúa la religión entre otras (...) formas superiores de la cultura que considera que deben avanzar. En segundo lugar, analizaré aquellos aspectos que harían una religión indigna de la altura de los tiempos y que motivan el ansia de reforma religiosa. Por último, en tercer lugar, dilucidaré la segunda concepción orteguiana de Dios compatible con la propuesta de una “nueva” religión. (shrink)

We present here a direct elementary construction of continuous utility functions on perfectly separable totally preordered sets that does not make use of the well-known Debreu’s open gap lemma. This new construction leans on the concept of a separating countable decreasing scale. Starting from a perfectly separable totally ordered structure, we give an explicit construction of a separating countable decreasing scale, from which we show how to get a continuous utility map.

This study explores the efficacy of a specific tool – the articulation of the ideal self – in job engagement, psychological well-being, and organizational citizenship behavior. We hypothesized that employees who can visualize their jobs as part of their ideal self – in particular how it helps in its development and realization – would feel higher levels of engagement and fulfillment in their lives, as well as engage in greater amounts of helping and voice OCB. A total of 239 full (...) time employees from five companies in Costa Rica filled out the ideal self questionnaire, the job engagement, and psychological well-being surveys, and were evaluated by their peers on task behavior and helping and voice OCB. Results of the SEM model showed that the ideal self was positively related to job engagement, psychological well-being and helping and voice. These findings contribute to the research on the impact and importance for organizations to help employees find meaningfulness in their work. (shrink)

The Purpose in Life Test is a measure of purpose in life widely used in many cultures and countries; however, cross-cultural assessments are scarce. The present study aimed to evaluate the cross-cultural measurement invariance of the PIL in the general population of seven Latin American countries. A total of 4306 people participated, selected by non-probabilistic convenience sampling, where Uruguay has the highest mean age ; while Ecuador has the lowest mean age. Furthermore, in each country, there is a higher proportion (...) of women than men. Using Multi-Group Confirmatory Factor Analysis, the factorial structure does not show evidence of invariance among the included countries. However, based on the Multi-Group Factor Analysis Alignment, there is evidence that a three-dimensional structure of the PIL is the same in the participating countries. Results based on item response theory indicate that most PIL items can significantly differentiate responses according to the level of life purpose. In addition, people with low life purpose will tend to choose the lower response alternatives on the PIL; while people with higher life purpose will choose higher response alternatives. The findings indicate that the PIL has the potential to increase knowledge about how people conceive and experience their purpose in life in different countries. (shrink)

El presente artículo discute los conceptos de «autoconservación» y «trabajo» en Lo que aprendemos de los lirios del campo y las aves del cielo. El análisis del discurso edificante escrito por Kierkegaard en 1847 permite definir la perspectiva que el danés asume ante el proyecto filosófico de la Modernidad. A partir de una crítica a las concepciones estéticas y éticas de la vida, el autor edificante propone un modelo de existencia religiosa que combina la autoconservación y la dependencia.

El presente artículo discute la obra pseudónima de Kierkegaard “El reflejo de lo trágico antiguo en lo trágico moderno”. El joven esteta A traza una distinción entre la “culpa antigua” y la “culpa moderna”. A utiliza esta distinción para formular una potente crítica a la ética moderna. No obstante, dicha polémica contra los conceptos éticos de la Modernidad no implican un retorno a la moralidad trágica antigua.

Self-control is deemed crucial for reasons-responsive agency and a key contributor to long-term wellbeing. But recent studies suggest that effortfully resisting one’s temptations does not contribute to long-term goal attainment, and can even be harmful. So how does self-control improve our lives? Finding an answer requires revising the role that overcoming temptation plays in self-control. This paper distinguishes two forms of self-control problems: temptation (the presence of a strong wayward motivation) and apathy (the lack of commitment-advancing motivation). This distinction makes (...) it possible to separate negative self-control (aimed at overcoming temptation) from positive self-control (aimed at overcoming lack of motivation). The paper argues that temptation should not play a central role in our conception of self-control, since overcoming temptation is neither necessary nor sufficient for successful self-control. This article questions Balibar’s claim that Simondon’s concept of the transindividual does not fulfil all the requirements for a materialist ‘philosophical anthropology’. In fact, we demonstrate that Simondon’s philosophy of individuation, and notably his concept of the transindividual, can be, as it were, included in a genealogy of aleatory materialism. Simondon’s philosophy of individuation is indeed a philosophy of the transindividual insofar as it involves the constant revision of the different historical forms taken by social relations in the coevolution of (...) human beings and their techno-social and natural milieu. Simondon’s way of conceiving anthropogenesis as an open and ‘metastable’ field in which individuals and processes relate to each other maintaining their own knowledge in motion, marks, in our view, a materialist style of thinking. Against this background we analyse Simondon’s overcoming of the dichotomy between the individual and society through a ‘double rejection’, we sketch his theory of a ‘double source’ for social relations, and we explain in what sense, from his perspective, the transindividual ‘can be said in many ways’. These studies examined whether having thoughts related to an event before it occurs leads people to infer that they caused the event— even when such causation might otherwise seem magical. In Study 1, people perceived that they had harmed another person via a voodoo hex. These perceptions were more likely among those who had first been induced to harbor evil thoughts about their victim. In Study 2, spectators of a peer’s basketball-shooting performance were more likely to perceive that they had (...) influenced his success if they had first generated positive visualizations consistent with that success. Observers privy to those spectators’ visualizations made similar attributions about the spectators’ influence. Finally, addi- tional studies suggested that these results occur even when the thought-about outcome is viewed as unwanted by the thinker and even in field settings where the relevant outcome is occurring as part of a live athletic competition. Este artículo se propone reconstruir la teoría de la elección del sí mismo en O lo uno o lo otro de Kierkegaard. La teoría ética de la auto-elección contiene una crítica de la auto-comprensión del individuo moderno y describe las patologías de la vida individual. Kierkegaard distingue dos modelos incorrectos de auto-relación, que implican un tipo de autocosificación existencial: auto-creación y auto-conocimiento.

The article develops the different meanings of the Simondonian idea of the transindividual, reconstructs the different interpretations that have been made about it, and considers its potentiality to think contemporary phenomena. For this, first, it points out the uses of the term transindividual before Simondon’s conceptualization of it. Second, it analyzes the definitions of the concept that appear in his doctoral theses of 1958 and distinguishes his different senses. Third, it reconstructs the contemporary debate about the transindividual and defines three (...) moments. Finally, it concludes by reflecting on the philosophical and epistemological potentiality of the idea of the transindividual to think about complex processes marked by the association of technological, psychosocial, and ethical-political dimensions.
